Article 11 

Nomination, Election and Installation

of Officers 

    Section 1.  The officers of this Local shall be elected for a three-year term to begin in July. 

    Section 2.  Nomination of officers shall be held every three years at the regular membership meeting in May, and the election of officers shall be conducted in June, not less than twenty-five days after the nomination meeting. 

All members in good standing shall have the right to nominate, vote for, or otherwise support the candidates of their choice.  At least fifteen days prior to the nomination meeting, the Executive Board shall mail a notice to the last known address of all members in good standing setting forth: (1) the date, time, and place of the nomination meeting and the offices to be filled; (2) the date, time and place of the election and the offices to be filled; and (3) the method of making nominations and such other information as the Executive Board deems appropriate or as might be required by applicable law. 

    Section 3.  To be eligible for nomination, a member must have been a member of the Local in continuous good standing for two (2) years prior to nomination.  All candidates must be present at the nomination meeting in order to be nominated, or, if unable to attend, a letter of acceptance signed by the candidate must be presented by the member nominating him.  All nominees present at the meeting must signify their acceptance of nomination.

    Section 4.  As candidates are nominated, the standing in the Local of the nominator and the candidate shall be checked by the First Business Reprsentative/Financial Secretary-Treasurer before the Presiding Officer permits the nomination to be listed. 

The First Business Representative/Financial Secretary-Treasurer shall have available all books, records and other information required to establish the eligibility of each nominator and candidate, such as length of membership, continuous good standing and payment of dues. 

    Section 5.  Where there are two or more candidates, their names will appear on the ballot in the order they were nominated. 

    Section 6.  After the close of the nominations, the Executive Board shall appoint an Election Committee, composed of one (1) Judge and two (2) Tellers, to conduct the election, whose duty it shall be to safeguard the secrecy and honesty of the election, prepare and count the ballots, and announce the results of the election in a signed statement.  After the ballots have been counted, the Judge shall deliver the ballots in a sealed package and other records pertaining to the election to the Executive Board, along with a statement signed by the Judge, the Tellers, the candidates, and the observers that said documents are the records of the election.  The Executive Board shall preserve said records intact for a period of one (1) year. 

    Section 7.  The election of all officers and delegates shall be secret ballot and the candidate receiving the greatest number of votes shall be declared elected.  Each member seeking to vote must present his/her dues card to the Election Committee for a check as to whether or not he/she is in good standing and eligible to vote.  Absentee ballots will be permitted to all members of Local No. 12 who are in good standing and are: 

1.    On an authorized paid vacation.

2.    Working out of town and are staying overnight in the area they are working in.

3.    The Local 12 members who are registered as sub-primary members or who are Service Office members. 

All requests for absentee ballots must be made no later than seven (7) calendar days before the election. Absentee ballots must be received by the Election Judge by 6:00 PM on the day of the election. Any candidate may have an observer at the polls, and at the counting of the ballots. In case of a tie vote, there shall be a run-off election at the next regular meeting. 

    Section 8.  In cases of an election complaint, the complaining members or candidate shall submit his/her complaint in writing to the Executive Board within seventy-two (72) hours after the subject matter of the complaint becomes known to the complaining member or candidate or within seventy-two (72) hours after the election results have been announced, whichever is sooner.  Such complaints shall be heard and determined promptly by the Executive Board.  A new election may be ordered only if it is determined that the matter complained of was a violation of applicable law and that it might reasonably have affected the outcome of the election. 

    Section 9.  Installation of officers shall be at the regular meeting in July following the election.  If an officer fails to appear for installation without good cause, as determined by the Executive Board, this shall constitute a resignation and the office shall be declared vacant. 

    Section 10.  The election of delegates to the International Convention and Central Bodies shall be conducted in accordance with the provisions of this Article and the International Constitution.  All members in good standing shall have the right to nominate and vote in the election of delegates to the International Convention and Central bodies.  Any member in good standing in the Local for at least two (2) year previous to nomination shall be eligible to be a candidate as a delegate to the International Convention
