Article 5 

Duties of Officers 

All officers, at the expiration of their term in office, when removed from office, or when their office is declared vacant, shall deliver to their successors all books, papers, money, or other property of the Union in their possession, and they shall not be relieved from their obligation until this duty is complied with. 

    Section 1.  President 

1.        It shall be the duty of the President to preside at all meetings of the Local; conduct the same in accordance with parliamentary rules; rule on all questions of procedure and points of order; have the deciding vote in case of a tie; announce the results of all votes; and enforce a due observance of order. 

2.        He/she shall enforce the provisions of the Constitution of the International and the Local Constitution and By-Laws, and also all duly adopted rules, resolutions, and regulations of the Local. 

3.        He/she shall appoint all committees unless directed otherwise by the Local. 

4.        He/she shall exercise general supervision over the interests of the Local and perform such other duties as may be assigned to him/her by the Local.   

Section 2.  Vice President. 

1.        It shall be the duty of the Vice President to assist the President in conducting the meetings of the Local.  In the absence of the President, he/she shall in every respect discharge the duties of the President.  He/she shall perform such other duties as may be assigned to him/her by the Local. 

Section 3. Recording Secretary 

1)    It shall be the duty of the Recording Secretary to keep minutes of all general membership and Executive Board meeting. 

2)    He/she shall have charge of the seal of the Local and attach the same to all documents requiring authentication. 

3)    He/she shall perform such other duties as may be assigned to him/her by the Local. 

    Section 4. First Business Representative/Financial Secretary-Treasurer 

1.        It shall be the duty of the First Business Representative/Financial Secretary-Treasurer to keep a correct account of each member's indebtedness, to receive the monies due the Local, and to give a receipt for same. 

2.        He/she, together with the Business Manager, shall sign official documents, bonds, contracts, and all checks issued by this Local. 

3.        He/she shall prepare monthly financial reports for presentation to the Executive Board and the membership. 

4.        He/she shall pay all obligations of the Local which have been duly authorized and he/she shall keep itemized records, including vouchers, receipts, work sheets, books and accounts, and resolutions pertaining to such expenditures. 

5.        He/she shall submit his/her records to the auditors for examination as directed by the Executive Board. 

6.        He/she shall perform such other duties as may be assigned to him/her by the Local.

    Section 5. Business Manager 

1.        The Business Manager shall be the principal officer of this Local.  He/she shall in general supervise, conduct and control all of the business and affairs of the Local. 

2.        The Business Manager, together with the First Business Representative/Financial Secretary-Treasurer, shall sign all official documents, bonds, contracts, and all checks issued by this Local. 

3.        The Business Manager shall have the authority to pay the usual and customary bills, obligations and indebtedness of the Local, which have been properly incurred, including current operating expenses, rents, utilities, salaries, expenses, and professional fees.  He/she shall seek the prior approval of the Executive Board for all expenditures, which are not usual and customary. 

4.        The Business Manager shall vigilantly protect the trade jurisdiction of the Elevator Constructors in the Elevator Industry in his/her locality.  He/she shall compel employers to observe and respect the Standard Agreement and Local Expense Agreements.  He/she shall adjust all grievances between members of his/her Local Union and their employers with justice and fairness and he/she shall have the authority to make the final decision regarding the resolution of all grievances at the Local level.  He/she shall foster and promote the employment of members of the Local. 

5.        The Business Manager shall have the authority to do all acts not expressly authorized herein which are necessary or proper in implementation of his/her duties for the protection of the property of the Local and for the benefit of the Local and its members. 

6.        The Business Manager shall maintain at the Local Office a copy of the Standard Agreement and a copy of any Local agreements the Local may have, together with all annual and financial reports required to be filed under the Labor Management Reporting and Disclosure Act of 1959.  The Business Manager shall make available for inspection by a member at the Local's principal office, any of the reports or agreement, which are subject, by statute, to inspection by Union members.  Upon request of a member, the Business Manager shall provide copies of documents to members as required by law or in his/her discretion, provided, however, that membership lists may not be copied. 

7.        He/she shall make a report at each Executive Board and regular membership meeting stating the number of members out of employment who have reported, the conditions of the trade, his/her general activities during the preceding period, and other matters of interest to the Local.  His/her report must be in writing and turned over to the Recording Secretary at each meeting.  He/she must keep regular office hours if a full time officer.  He/she shall perform such other duties as the Local may direct, or this Constitution and By-Laws may require. 

8.        In case of the absence of the Business Manager and Business Representative, the President may fill in during his/her absence or appoint some other member of the Local to serve as Acting Business Manager.  The Acting Business Manager shall be paid by the Local for any time he/she shall lose from regular work.  The Acting Business Manager shall not have the authority to change what have been considered established practices and procedures of the Business Manager without the prior approval of the Executive Board. 

9.        Election to the office of Business Manager shall constitute the Business Manager's election as a delegate to Local and State Central Bodies and Local and State Building and Construction Trades Council.  If the Business Manager is a full time weekly salaried officer, his/her election to the office of Business Manager shall constitute his/her election as a delegate to the International Union of Elevator Constructor's Convention. 

10.    In the event that a Business Representative or Business Representatives are deemed necessary by the Executive Board or required by the International Constitution, the filling the position or positions shall be done by election in accordance with the provisions of Article 11. 

    Section 6.  Trustees 

1.        The Trustees shall review all reports of the First Business Representative/Financial Secretary-Treasurer on a monthly basis and all audits.  After such review and the resolution of any questions, which may arise, the Trustees shall sign the document, which they have reviewed, thereby signifying their approval. 

2.        The Trustees shall review all investments, property and funds of the Local and shall perform such other duties as may be assigned to them by the Local.
